1. The notion of social network or social media

A distinction is often made between social networks and social media.

Like any interpersonal network, the main purpose of social networks is to connect individuals, including legal entities or institutions. The archetype is of course Facebook, let’s also remember its professional equivalents LinkedIn and Viadeo. Twitter is also linked to it.

Social networks, on the other hand, are more aimed at distributing or sharing media created or promoted by account holders. YouTube, Dailymotion and other Vimeo are, as such, emblematic.

Common networking or media point: everyone can like messages, posts or videos and add comments. The two concepts of networks and social media interpenetrate since it is possible to post videos on Facebook and even on Twitter.

2. Between intellectual property and sharing communities

The difficulty of the matter is the fundamental dichotomy between the private rights of authors over their works -recognized almost universally- and the free sharing communities that are social networks.

For this, in terms of copyright, there is already an alternative: these are the so-called Creative Commons licenses (creative communities) by virtue of which authors authorize a more or less extensive reuse of their works for free and without any agreement other than the license published together with the….
